This briefing sets out the basic procedures for public inquiries for new roads (which includes the Leigh Guided Busway). A more detailed briefing will be available on objections to the proposals once the application has been published. There also links to the Regulations and other legislation on the Busway WEB site.
It is expected that the Busway application will be submitted in early to mid May, followed by a 42 day period for objections, then a public inquiry in November or December, there is also likely to be pre-inquiry meeting prior to that, which will set out the agenda for the inquiry. All of these dates will be published by the applicants in local newspapers, the application notice it self will also be erected on posts along and adjacent to the route. Details of who to contact, and where will be included in those notices, however we shall also put this info in a leaflet for distribution. We shall also distribute sample letters of objection soon after the application notice is published. This will allow sufficient time for more public meetings, and briefings to be distributed.

'The applicant shall publish, in the newspapers ……… such notice to be published on 2 separate occasions, the first publication to be not more than 14 days before, and not later than, the date of the application and the second to be not more than 7 days after the date of the application'.
On routes greater than 5 kilometres the applicant shall place notices along the linear route at least once every 5 kilometres, in a place easily assessable to the public (in reality the notices are usually placed more frequent than that.
In both the above the following has to be included, there are other matters to be included, aspects such as road closures and diversions require separate notices.
A copy of the application, and of all plans and other documents submitted with it, may be inspected free of charge between the hours of (b) and (b) on (b) to (b) at (c) until (d).
Any objections to, or other representations about, the proposals in the application should be sent to the Secretary of State [title] c/o [Departmental address] on or before [expiry date for objections]. An objection or representation MUST (i) be received by the Secretary of State on or before [expiry date for objections], (ii) be made in writing, (iii) state the grounds of the objection or representation and (iv) indicate who is making the objection or representation, and (v) give an address to which correspondence relating to the objection or representation may be sent.
There will be further notices for the inquiry it self, but they are for the future. The notices are sent to the Secretary of State, normally this is the Government Office for the North West, however there is a case pending before the House of Lords that may alter that, so we leave those details until the application is published.
Details of the application will be deposited at the local authority offices in Wigan and Salford, and normally in local libraries, which would mean Leigh, Tyldesley, Walkden and Booths Town. If at all possible, take the time to look at these, we shall obtain copies and make the information available as widely as possible.
The development should be declared an EIA development, which means there will need to be a full assessment of the environmental consequences. Which is far more than the wildlife on the site, or pollution, again once we know what the ES says we will publish a briefing, and advise on what to do next.
We also need to have as much information as we can, so please inform us of anything interesting that you might discover, what preliminary work is taking place, keep an eye open for our newsletters, and follow the requests for letter writing and so forth. In particular keep an eye open for fund raising events. If we are to be successful then it is vital that we raise a large fund, potentially we could need as much as £5000 to £7000 to present our case, and have a chance of winning.
