RE: APPLICATION TO REGISTER .................... AS A VILLAGE GREEN
In regards to the above application and the procedures for determining the same, whilt the Government have indicated that at some sage they will issue guidance of the process and procedures to be used within the determination process, and the findings of the Courts that in the majority of cases that the applications should be determined by a local inquiry. We feel it wuld be in the interests of all the parties if the Registration Authority were to put in place its own guidance on procedure, and as such we suggest the following.
We accept that where there is an inquiry that it is a non statutory local inquiry, howevr, as we say above in order to get some clarity and organised procedures in place that for the purposes of this application in as far as it is appropriate that the Registration Authority should adopt for the want of a better procedure the Town and Country Planning (Inquiries Procedure) (England) Rules 2000 (S.I. 1624). Should the Registration Authority disagree with that suggestion then in order that all parties can fully understand and be working to a defined process we request that your authority set out in clear and precise terms the process and procedures that your authority intend adopting both pre inquiry and during the inquiry. Albeit that we appreciate that much of the process at the inquiry will be for the appointed inspector to set out.
