RE: RAIL TRACK PRIVATE TELECOMMUNICATION SYSTEM INSTALLATION - LAND AT ����������������. ������������������������������

In reference to the above installation for the installation of a communication tower by Rail Track. It is our understanding that Rail Track are invoking the provisions under Section 'A' of Part 17 of the Town & Country (General Permitted Development) Order 1995 (GPDO) which relates to the provision of development required for the movement of rail traffic.

It is our view the proposed installation of a ��. metre high communication tower for a microwave antenna does not fall within the general category of development required for the movement of rail traffic, or if it does then the use of that equipment can only be for that specific purpose, and not as a general communication system for Rail Track, or the Rail Operators.

In our view the correct procedures are those set out in Part 25 'A' of the GPDO which relates to the installation of microwave antenna and the structures that they are attached to by none Telecommunication System Operators. The basics of which are that all installations higher than 15 metres require full planning permission.

As such we urge your authority to consider taking enforcement action to ensure that this installation is brought within the full planning process, thereby enabling your authority to have an input in and filter out any inappropriately sited installations, as well as giving members of the public an opportunity to comment upon the proposals.
