RE: TELECOMMUNICATION INSTALLATIONS - DEMINIMUS (small antenna)
As a local resident I am concerned at the telecommunication installation that has been installed at ............. This appears to be a Small Antenna within the terms set out in A.1(o) of Part 24 of the General Permitted Development Order (GPDO). Whilst I accept that this is permitted development, however I am very concerned that the inability of the public to make representations, and have their concerns taken into account is violating my rights contained within Article 6.1 of the European Convention on Human Rights and Fundamental Principles (ECHR).
As such we request that in the first instance you monitor the installation in order to ensure that the various provisions of planning policy and legislation is adhered to, and where appropriate that your authority takes enforcement action. Further we request that your authority lobbies the Government in order to ensure that provisions within the telecommunication planning process requires that all applications require consideration by the local planning authority, and that concerns of the public are taken into account.
In order that a controlled role-out of telecommunication installations within the borough we suggest that it would be beneficial to the community as a whole if your authority were to enter into negotiations with the system code operator in order that a more suitable site that is not in a location that is likely to cause concerns to local residents, and which is more in keeping with the policies of your authority for the maintaining the good amenity of the area can be allocated so as to cater for the needs of the operator.
Even though your authority have a limited ability to participate in the planning decision making process for this type of installation, there are circumstances that other forms of permission may be required by the telecommunication system code operators, we therefore urge your authority to be vigilante in insuring that within those more limited opportunities that you are able to reduce the number of installations to the minimum. Illustrations are where the proposed installations are on council controlled property, such as street lamps where your finance committee may be involved in determining contracts for the supply.
Please keep me informed as to your authorities position in relation to this installation.
